Website Terms of Service
1. Agreement and Scope
These Website Terms of Service ("Terms") govern access to and use of the website, contact forms, and related online content operated by Working Answer Group LLC, a Maryland limited liability company ("Working Answer Group," "we," "us," or "our") (collectively, the "Site"). By accessing or using the Site, you agree to these Terms to the extent enforceable under applicable law. Where we request affirmative acceptance, clicking the applicable unchecked checkbox indicates your assent to the terms presented. If you do not agree, do not use the Site. If you act for an organization, you represent you have authority to submit information on its behalf; acceptance does not, by itself, establish your authority to bind it to a consulting engagement.
2. Site Purpose; No Engagement
The Site describes business operations, IT and infrastructure, cybersecurity and risk, people operations, revenue operations, and related advisory services. Content is general information, not a binding offer, professional opinion, or guarantee. A contact form, inquiry, meeting, discussion, proposal request, or information exchange does not create a consultant-client relationship, duty to perform services, or contract for services. Any paid or unpaid engagement requires a separate mutually accepted written agreement defining its scope, fees, responsibilities, deliverables, and other terms.
3. Eligibility and Permitted Use
The Site is intended for persons aged 18 or older and people acting for lawful business purposes. You may use it to review our services and make legitimate inquiries. You may not introduce malicious software; attempt unauthorized access; scrape or overwhelm the Site; interfere with other visitors; impersonate another person; or submit material that infringes rights or violates law. We may suspend access to address misuse or security concerns.
4. Our Content and Intellectual Property
Our original Site text, design, graphics, branding, and other materials belong to Working Answer Group or its licensors and are protected by applicable intellectual property laws. We give you a limited, nonexclusive, revocable permission to view the Site and download or print reasonable excerpts for internal evaluation of our services. You may not sell, redistribute, misrepresent, or commercially exploit our materials without permission. Third-party marks remain their owners’ property.
5. Inquiries and Materials You Submit
You may provide business contact information, descriptions of possible projects, and supporting information ("Submissions"). You represent that you have the right to share them and that they contain no malicious code. You retain your rights in your Submissions. You grant us the limited permission needed to receive, securely process, review, store, and respond to your Submissions; assess whether an engagement is suitable; comply with law; and retain appropriate business records. This permission does not transfer ownership or authorize sale of your proprietary material.
6. Confidentiality and Mutual NDA
We provide an MNDA for prospective engagement requests. The website must display its full terms and secure separate, affirmative acceptance of the MNDA and these Terms before submission. The MNDA becomes binding only when both the submitting party and Working Answer Group validly assent through the implemented process. For information protected by an effective MNDA, its confidentiality, permitted-use, disclosure, survival, and remedies provisions govern ahead of these Terms. Do not upload classified data, account credentials, export-controlled files, highly sensitive regulated records, or material you lack authority to disclose through the public form. We may arrange another secure method before receiving those materials.
7. Privacy and Communications
Our Privacy Policy describes collection and processing of personal information from inquiries, attachments, site usage, analytics, and marketing. We may contact you to respond to your inquiry or discuss a potential engagement. Newsletter and promotional subscriptions are optional and require a separate choice; acceptance of these Terms or an MNDA does not itself subscribe you to marketing. You may unsubscribe from commercial messages as explained in the Privacy Policy and in those messages.
8. No Professional Advice or Guaranteed Results
Site content is not legal, investment, tax, accounting, clinical, or other regulated professional advice. We do not promise outcomes or security, revenue, compliance, or operational performance through Site materials. Prospective clients should obtain advice from properly licensed advisers as needed. Any professional assurances regarding a consulting project must appear in its separate written agreement.
9. Third-Party Links and Platforms
The Site may link to websites or use hosting, forms, communications, or other third-party services. We do not control unrelated third-party content, availability, or policies, and links are not endorsements. Third-party terms may apply to your use of those services.
10. Site Availability and Disclaimer
We may modify or suspend Site content or functions. To the extent permitted by law, the Site is provided "as is" and "as available," without warranties of uninterrupted access, accuracy, fitness for a particular purpose, or freedom from errors or malicious activity. Nothing here diminishes warranties expressly provided in a separate consulting agreement or rights that cannot be waived.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Working Answer Group and its members, managers, employees, and representatives are not liable for indirect, special, incidental, consequential, exemplary, or punitive damages attributable to use of the Site. Our aggregate monetary liability arising solely from the Site or these Terms will not exceed US $100. These limitations do not apply to fraud, intentional wrongdoing, gross negligence, or other liability that law does not allow us to limit. They do not amend liability terms in a separate MNDA or consulting agreement.
12. Your Responsibility for Misuse
To the extent permitted by law, you agree to reimburse us for reasonable losses, third-party claims, and legal expenses caused by your intentional unlawful misuse of the Site, malicious submissions, or knowing infringement of third-party rights. You are not responsible under this section for harm caused by our own gross negligence, willful misconduct, or unlawful acts.
13. Governing Law and Disputes
Maryland law governs these Terms, excluding conflict-of-law principles. Before filing a claim, the parties should attempt reasonable good-faith informal resolution, except where urgent relief is needed. Subject to applicable law and jurisdictional requirements, actions concerning these Terms may be brought in the courts of competent jurisdiction in Montgomery County, Maryland, or the US District Court for the District of Maryland. Nothing here overrides the dispute procedure of a separately effective MNDA or consulting agreement.
14. Electronic Acceptance
We may request distinct affirmative acceptance of Website Terms and the MNDA using unchecked checkboxes alongside access to each document. Our electronic records may retain form time, version, recorded selections, and submission identifiers. The parties agree to conduct the applicable website transaction electronically where a valid agreement to do so is established under governing law. No separate consulting engagement is created by a form submission.
15. Updates; Severability; Waiver
We may revise these Terms and post a new effective date. Material changes apply prospectively, with further notice or renewed consent where required. If a provision is invalid, the balance remains effective to the extent lawful. Failure to enforce a provision is not a waiver of future enforcement.
16. Other Agreements; Priority
These Terms govern only general Site use. A properly entered consulting agreement controls the relevant engagement, and an effective MNDA controls covered confidentiality matters. These separate agreements supersede inconsistent Site Terms solely for their subject matter. No engagement or MNDA is amended through an unaccepted change to this Site.
17. Contact and Legal Notices
Working Answer Group LLC is a Maryland limited liability company, Maryland Department ID W27745116. For inquiries about these Terms, use the Contact page linked from this Site, including for electronic notices where legally permitted. Formal notices requiring physical delivery may be sent by an authorized method to our current registered agent or registered office as listed in Maryland public business records. We may require additional information to verify a request.
